Passenger Liability Waiver and Hold Harmless Agreement

1. Acknowledgment and Assumption of Risk

I, the undersigned passenger, voluntarily choose to use transportation services provided by VIP Elite Transportation LLC (“the Company”).
I understand that travel in any vehicle involves inherent risks including, but not limited to, movement of the vehicle, entry and exit, interaction with other passengers, and actions of third parties.
I freely assume all risks of injury, illness, property damage, or loss that may occur during or in connection with transportation services.

2. Release and Waiver of Liability

In consideration of being permitted to use the Company’s vehicles and services, I hereby release, waive, and discharge VIP Elite Transportation LLC, its owners, officers, drivers, employees, affiliates, and contractors from any and all liability, claims, demands, or causes of action arising out of or related to any injury (including death), property damage, delay, or other loss, whether caused by negligence or otherwise.

3. Indemnification

I agree to indemnify, defend, and hold harmless VIP Elite Transportation LLC from any loss, liability, damage, or cost (including attorney fees) that arises from my actions, negligence, or violation of this agreement while using the Company’s services.

4. Conduct and Safety Rules

I agree to follow all driver instructions and comply with Company safety policies.
I understand that the Company reserves the right to refuse service or remove any passenger whose behavior is unsafe, illegal, or disruptive, without refund.
If alcohol is permitted as part of the event, I acknowledge that I am of legal drinking age (21 years or older) and agree to consume responsibly.

5. Property and Personal Belongings

The Company is not responsible for lost, stolen, or damaged items left in any vehicle.
Passengers are responsible for checking their belongings before exiting.

6. Damage and Cleaning Fees

I agree to be financially responsible for any damage, excessive cleaning, or repair to the vehicle caused by myself or my guests during the booking period.

7. Cancellations and Delays

I understand that weather, road, or mechanical conditions may cause delays or cancellations beyond the Company’s control. The Company will make reasonable efforts to complete the trip safely but is not liable for consequential damages or missed events.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma, and any disputes shall be resolved in Woodward County, Oklahoma.

9. Acknowledgment of Understanding

I have read this Liability Waiver and fully understand its terms.
I acknowledge that I am giving up substantial legal rights by signing it and sign it freely and voluntarily.
